By accessing or using ezysplit (the "Service"), operated by ezysplit Pty Ltd (ABN XX XXX XXX XXX) ("ezysplit", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Description of Service

ezysplit is a document preparation platform that helps users complete their Financial Statement (Form 13) for family law matters in Australia. The Service includes:

Online forms for entering financial information
Open Banking integration for importing bank data
AI-powered property and vehicle valuations
Document storage and management
PDF generation of Financial Statements
Collaborative features for working with ex-partners

ezysplit is not a law firm and does not provide legal advice. The Service is a document preparation tool designed to help you organise and present your financial information. We do not:

Provide legal advice or legal representation
Recommend legal strategies or courses of action
Guarantee any specific outcome in court proceedings
Act as your lawyer or solicitor

Eligibility

To use ezysplit, you must:

Be at least 18 years of age
Be located in Australia
Have the legal capacity to enter into these Terms
Provide accurate and complete information

Account Registration

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password confidential and secure
Notify us immediately of any unauthorised access
Be responsible for all activities under your account

Your Responsibilities

When using ezysplit, you agree to:

Provide truthful and accurate financial information
Comply with your duty of disclosure under Australian family law
Not use the Service for any unlawful purpose
Not attempt to circumvent security measures
Not share your account credentials with others
Not upload malicious content or attempt to harm the Service

Collaborative Mode

If you invite your ex-partner to collaborate on a Financial Statement:

You are responsible for obtaining their consent before sending an invitation
Information you mark as shared will be visible to them
You can control what information is shared through privacy settings
We are not responsible for disputes between you and your ex-partner

Fees and Payment

ezysplit offers both free and paid features. For paid services:

Prices are displayed in Australian dollars (AUD) and include GST
Payment is processed securely through our payment provider (Stripe)
Fees are one-time charges, not subscriptions
Refunds are available within 30 days per our money-back guarantee

Refund Policy

We offer a 30-day money-back guarantee on all paid plans. If you are not satisfied with the Service, contact us within 30 days of your purchase for a full refund. Refunds are processed to the original payment method within 5-10 business days.

AI Valuations

ezysplit provides AI-powered property and vehicle valuations for convenience. These valuations:

Are estimates based on available market data
Are not formal valuations from licensed valuers
Should not be relied upon as definitive values for court
May differ from professional valuations

For contested matters, we recommend obtaining a formal valuation from a licensed valuer.

Open Banking

If you connect your bank accounts through Open Banking:

You authorise us to access your banking data through the Consumer Data Right (CDR)
Data is accessed securely using government-regulated protocols
You can revoke access at any time through your bank
We comply with all CDR rules and requirements

Intellectual Property

All content, features, and functionality of the Service are owned by ezysplit and protected by Australian and international intellectual property laws. You may not:

Copy, modify, or distribute our content without permission
Use our trademarks or branding without authorisation
Reverse engineer or decompile the Service
Remove any proprietary notices from our materials

Your Content

You retain ownership of any content you upload to ezysplit. By uploading content, you grant us a limited licence to store, process, and display that content for the purpose of providing the Service to you.

Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

The Service is provided "as is" without warranties of any kind
We do not guarantee the accuracy of AI valuations or imported data
We are not liable for decisions made based on information in the Service
Our total liability is limited to the amount you paid for the Service
We are not liable for indirect, consequential, or punitive damages

Indemnification

You agree to indemnify and hold ezysplit harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. You may also delete your account at any time. Upon termination, your right to use the Service ceases immediately.

Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where practicable.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and ezysplit.
